Allahabad High Court has awarded Rs 1 lakh compensation to a student of Agra University who was declared failed at first instance due to negligence of examiner of Agra University but later when his copies were re-evaluated following direction of this court, he was declared passed.
Allowing a writ petition filed by Devarsh Nath Gupta, a division bench comprising Justice Sudhir Agarwal and Justice Rajendra Kumar IV directed that the cost (compensation), at the first instance, shall be payable by Agra University but it shall have the liberty to recover the amount from the concerned examiner after holding such enquiry as provided in law.
