WILMINGTON — After spending three days in Will County’s Jail, 41-year-old Wilmington resident Brian Carey Jr. has regained his freedom following last week’s arrest in connection with allegations he tried to strangle a woman in her 60s.
Prosecutors in Will County have charged Carey with aggravated domestic battery, two counts of aggravated battery and two counts of domestic battery.
The criminal complaint indicates that last Wednesday, Carey tried to strangle a woman who is more than 60 years old and grabbed her about the neck and pushed her about the body. Carey also has a 2009 domestic battery conviction from Stephenson County, prosecutors outlined.
According to the petition to deny pretrial release for the Wilmington man, around 4:45 p.m. on Aug. 21, Wilmington police were called to the 500 block of Bremer Street to assist the Wilmington Fire Department. The caller told authorities that Carey was in a bipolar state, and he had tried to choke her.
Wilmington’s paramedics are familiar with Carey and have seen him many times for psychological evaluations, court records point out.
“Brian has ongoing mental health issues,” prosecutors told the judge.
During last week’s emergency, prosecutors said the 60-year-old woman refused an ambulance transport and when two Wilmington police officers arrived, they found Carey underneath the awning. He was put in handcuffs and no weapons were found.
“Brian sat down in the chair and began talking about how he figured it out. Brian advised he figured out why his girlfriend … was missing,” prosecutors indicated.
When asked about the attack upon the 60-year-old woman, “Brian advised he shoved her against the counter and choked her,” court files show. “Brian advised (she) got in his face and Brian shoved her. Brian began to state his family owns Caterpillar and Indian motorcycles, but they do not have any money, and he is trying to figure out where it went.”
According to prosecutors, “Brian also advised he believes his mother … is not his real mother because she is too pale, and his real mother is half Indian, so she should be much more red.”
Carey signed a medical refusal for treatment from Wilmington’s paramedics. Meanwhile, Wilmington Police Detective Samantha Sullivan spoke with the victim, whose neck was visibly red and irritated, and she was shaking and upset.
The victim told Wilmington’s detective “that Brian held her by her throat up against the counter and yelled that he was going to kill her,” prosecutors stated. “When asked if she felt her air supply had been cut off while Brian was choking her, (she) stated ‘yes.'”
The victim “stated she wanted Brian to get help and did not want him to go to prison.”

Despite the prosecution’s effort to keep Carey in Will County’s Jail, Will County Judge Matthew Bertani ordered the Wilmington defendant’s release. However, Carey must stay away from the victim and her house in the 500 block of Bremer Street. He will remain on electronic monitoring and complete a mental health evaluation, Judge Bertani wrote.
Carey’s next hearing at the Will County Courthouse is set for Sept. 6 in Courtroom 405.
